MOUNTAIN MOTOR CLUB SMS / Text Messaging Terms & Conditions

1. Program Description

Mountain Motor Club (“we,” “us,” or “our”) operates an SMS/MMS text messaging program
(the “Program”) for customers and prospective customers of our Used Car Dealership.
This messaging service is used for conversational, customer-initiated communication
regarding vehicle availability, pricing, and general inquiries about our inventory.
Customers may also receive follow-up messages related to vehicles they have expressed interest in.

By opting in, you agree to receive these text messages from us at the mobile number you provided.

2. How to Opt In

You may opt in to receive text messages from us in any of the following ways:

  • Submitting your mobile number through a form on our website at https://mmcutah.com and checking the SMS consent box
  • Texting our published business number from your mobile phone
  • Providing your mobile number in person, over the phone, or in writing and affirmatively agreeing to receive text messages from us
  • Replying to a confirmation text message from us with an affirmative response such as YES or START

Consent is not a condition of purchase.
You are not required to agree to receive text messages in order to buy a vehicle or use any of our services.

3. Message Frequency

Message frequency varies.
You will only receive messages in response to your inquiries or as reasonable follow-up
regarding vehicles or services you have expressed interest in.

4. Message and Data Rates

Message and data rates may apply.
Standard carrier charges from your wireless provider for text messaging, data usage,
or both may apply to each message sent or received.
Please contact your wireless provider for details about your specific plan.

5. How to Opt Out (STOP)

You can cancel the SMS service at any time by texting STOP
to the number from which you received the message.
After you send STOP, we will send you a one-time confirmation message
acknowledging that you have been unsubscribed.
You will not receive any further messages from us unless you opt in again.

The following commands will also unsubscribe you from the Program:
STOP, END, CANCEL, UNSUBSCRIBE, QUIT.

6. How to Get Help (HELP)

If you are experiencing issues with the messaging program,
reply with the keyword HELP for additional assistance,
or contact us directly at [email protected].

7. Supported Carriers

Carriers are not liable for delayed or undelivered messages.
The Program is available on most major U.S. wireless carriers, including (but not limited to)
AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, MetroPCS,
Virgin Mobile, Cricket, Google Voice, and others.

T-Mobile is not liable for delayed or undelivered messages.

8. Privacy

We respect your privacy.
Mobile information you provide to Mountain Motor Club in connection with this Program
will not be shared with any third parties or affiliates for marketing or promotional purposes.

All other categories of data are subject to our Privacy Policy, available at
https://mmcutah.com/privacy-policy.

No mobile information will be shared with third parties or affiliates
for marketing or promotional purposes.
Information sharing to subcontractors in support services, such as customer service, is permitted.
All other use case categories exclude text messaging originator opt-in data and consent;
this information will not be shared with any third parties.

9. Eligibility

By opting in to the Program, you represent and warrant that you are at least 18 years of age,
that you are the account holder or have authority from the account holder of the mobile number you provide,
and that you are responsible for any message or data charges your wireless carrier may assess.

10. Changes to These Terms

We may modify or cancel the Program or any of its features at any time, with or without notice.
We may also revise these Terms from time to time.
Material changes will be posted on our website,
and continued participation in the Program after such changes constitutes your acceptance of the revised Terms.

11. Disclaimer of Warranties

The Program is provided on an “AS IS” and “AS AVAILABLE” basis.
We do not warrant that the Program will be uninterrupted, timely, secure, or error-free,
or that messages will be delivered in a timely manner.
